The longer you wait in collecting this evidence, the easier it is for evidence to be lost or to degrade to the point that it becomes unclear what happened.
If you are at all able after your accident, get pictures of the whole scene, note where any cameras are that might’ve taken video, and get the contact information of any witnesses who might be able to testify. Without this report, it becomes easier for the insurance company to dispute the details of the claim.
As soon as possible after your accident, get a copy of the report so that you can review it. It’s always possible for mistakes to be made in these situations, and if you notice an error, talk to your lawyer about politely requesting that either the investigating officer or the store manager correct the error. If you take care of this early on in the process, memories are still fresh and the person may agree quickly to amend and update the report.
Not Getting Medical Help
Your medical expenses are typically going to be a big part of your compensation claim, and your non-economic damages, such as mental anguish or pain and suffering, will be calculated in relation to the total of your economic damages, including your medical losses. If you have been badly injured at the scene of an accident, it’s likely you were taken to the hospital quickly. But if you weren’t, you still need to be sure to visit a doctor as soon as possible after the accident.
Sometimes people don’t do this because they feel fine and they don’t think it’s necessary, but this can be a costly mistake in every respect. Most importantly, some injuries, and some very serious injuries, in fact, don’t manifest with symptoms immediately. But there’s another problem, too: if you don’t follow through on everything your doctor says, you put your claim at risk. Admitting Fault
