Make Sure to get an Injury Consultation early
At Cesar Ornelas Law, we receive phone calls from personal injury victims who speak to an attorney for the first time several months after an accident. By then, we often find that the damage to their case has been done. At this point, the insurance company has already received the benefits for the defendant.
One of the biggest mistakes personal injury victims make is assuming that the insurance company will be fair. Despite what you may think, insurance companies are not on your side. We are here to tell you that they are not concerned with fairness and do not have your best interest at heart.
When most victims hear that their insurance company has “accepted responsibility,” they assume that the insurance company treating them fairly. The opposite is true when an attorney is not present.
Cesar Ornelas Law will talk with you about your case
To get the settlement you deserve, you need someone who is actively seeking justice for you. Our team of experienced attorneys offers a free consultation to all personal injury victims. We take the time to answer your questions and provide useful information regardless of whether you are hiring us to pursue the case for you.
In our experience, personal injury victims experience a sense of relief after a free consultation because they know that our team will fight for them.
Taking as little as ten minutes to speak with one of our experienced attorneys about your insurance claim will make a huge difference in the outcome of your case.
Through a free consultation, you will gain insight into your rights and what the best next steps may be., Our attorneys take the time to educate you on common practices that accident adjusters use, which leads to a sense of control on your end. The more you know about your case, the better.
Common Mistakes Injury Victims Make
One of the most important things you can do after an accident is photographs of your vehicle’s damage. Attorneys use these photos to support your injury claim, and the visual representation of the accident is a major help to all parties.
Please do not assume that the insurance company will take photographs for you and store them in an accessible place.
It is common practice for an insurance agent to check out your car in the destination it was towed to, but this does not mean they are gathering evidence to help you. Taking the pictures by yourself and sharing them with an attorney is your best bet.
The insurance company does not take photos to help your case. They are known only to take photos if they believe it will benefit their defense of the claim.
We have seen adjusters take photos of slightly damaged areas when the car was completely totaled in reality.
Hoping it will get better on its own
Don’t try to tough it out. That tactic is not useful when it comes to personal injury claims. Even if you feel that your injuries are minor, they are important. We have seen clients with injuries that began as minimal but resulted in lasting damage.
As previously mentioned, many clients will wait weeks or months before they realize that their injury will not go away on its own. Our team will set you up with doctors within your network, manage your appointments and follow up with you to monitor your progress.
Keep in mind that the delay in seeking medical attention benefits the insurance carrier. Suppose an injury is not reported in a timely manner. In that case, adjusters can claim that the accident was not the cause of the injury or that the injury is not serious enough to warrant your medical bills being covered.
A delay in reporting an injury also affects your treatment plan with physicians. When months go by, they have a more challenging time giving an opinion on the injury as too much time as past to trace its actual origin.
Expecting insurance companies to be fair
Insurance companies are not your friends. Their adjusters are not paid to be fair to the claimant, and this often shows up in how the case is handled. When they save money on a claim, it makes them look good, which is why they will pay you as little as possible for your accident.
Every injury victim is at risk for falling for the line that insurance companies “assume responsibility.” Usually, personal accident sufferers often do not realize that they need an attorney until the conversation of compensation comes into play.
What do you have to lose?
If you were in a car accident and got hurt, speaking to an experienced attorney at Cesar Ornelas Law cannot hurt. If you are trying to negotiate the case yourself, you need a lawyer on your side.
